Organic 2022/23, classes in derogation: what they are and training criteria. 8741 Plaze expected

Law no. 234/2021 provided for the constitution of the classes and the derogation of the parameters dictated by Presidential Decree no. 81/09. How many places can be activated? By what criteria?

Organic Note and Decree 2022/23

The MI sent DI n.90 / 2022, which indicates the organic endowments of the teaching staff of the common places, of the strengthening, the support and the adaptation of the staff to the current situations for the academic year 2022/2023 .

The said decree, as we see in note no. 14603/2022, presents the school year 2022/23:

  • the redesign of the overall need for teachers, with an indication of it
    for the teaching of Ed. Motor in primary school for fifth grade;
  • the estimate of the number of fifth-graders in which motor education can be activated, and the relative maximum limit of the number of places, including the equivalent, at the provincial level, of the hourly contributions of two hours per class brought back to places throughout;
  • the forecast of the maximum proportion of teaching staff allocated to the classes
    established as an exception to the dimensions identified by Presidential Decree 81/2009, divided by region.

Here are all the figures relating to the posts of autonomy staff (municipalities, support and strengthening) and the adaptation of the said staff to the current situations.

Classes though

Article 1, section 344, of Law no. 234/2021, to favor the effective use of the right to education also by disadvantaged persons placed in classes with a number closer to or more than the limits set by Presidential Decree no. 81/09authorized to establish MI classes in the derogation of the above limits.

The derogation can be applied to schools, which are characterized by social, economic-cultural and early graduation indices, identified by a specific inter-ministerial decree.

Limits of the Presidential Decree 81/09

These are the limits regarding the formation of the classes specified in the DPR n. 81/09:

  1. the school sections of theChildhood it consists, as a rule, with a number of children of not less than 18 and not more than 26, except for classes which welcome children with disabilities (which usually consists of not more than 20 pupils); where it is not possible to redistribute children between neighboring schools, all surplus enrollments are divided into different sections of the same school without exceeding 29 units per section (sections welcoming students with disabilities are excluded from the redistribution );
  2. School classes primary it usually consists of a number of students not less than 15 and not more than 26, which can be increased to 27 if they stay, except for classes that welcome students with disabilities (which usually do not exceed 20 students);
  3. the first classes of of Secondary it usually consists of no less than 18 and no more than 27 pupils, which can be increased up to 28 if there are still remnants left. A single first class is formed if the number of enrolled students does not exceed 30 units (except for classes that welcome students with disabilities, usually no more than 20 students). A number of second and third classes is equal to that established by the first and second classes of origin, provided that the average number of students per class is equal to or greater than 20 units;
  4. the classes of the first year of the Secondary Schools it usually consists of no less than 27 students; all remnants are distributed among the classes of the same institution, if it is not possible to transfer the surplus applications to the neighboring institutes of the same order in the same manner, without, however, exceeding the number of 30 students per class; a single class is constituted if enrollment is not more than 30 units (with the exception of classes that welcome students with disabilities, usually no more than 20 students). The middle classes (II-IV) are composed in a number equal to that of the classes of origin of the pupils, so long as they are formed with an average number of pupils not less than 22; the final classes (classes V) are in a number equal to those of the corresponding ninth classes operating in the current school year, provided that they contain at least 10 pupils.

These limits, as mentioned at the outset, may be waived in the presence of certain conditions, as set out below.

Places intended for classes and derogation

DI n. 90/2022, and implementation of law no. 234/2021, provides for the forecast of the maximum proportion of teachers assigned to the classes established in the derogation of the above-mentioned boundaries, with the equivalent estimate of the classes, if all by derogation exclusively in the high school are activated. .

The number of places allocated to the classes in the derogation is 8,741, while the equivalent estimate of the classes, if activated as a deviation exclusively in the high school, is the same as 4523. Table 2, attached to the named DI, shows the subdivision by region:

In the above note it is specified that the number of places that can be activated by region (indicated in the DI), if all the classes in the derogation are established in the secondary school of II-degree, is indicative because it d ‘The possibility remains, through the USR, to manage critical situations in other levels of education as well.

It should be noted that the above items are not additional, but fall within the overall quota of joint posts and posts to strengthen the workforce by law (identified in Table A-A1 linked to DI n.90 / 2022).

Criteria for establishing classes in derogation

As mentioned above, the constitution of the classes and the derogation is provided for schools, which are characterized by values ​​of the indices of social, economic and cultural status and early school exchange. These indices are identified by a specific inter-ministerial decree which, as we note in note no. 14603/2022, is currently in consultation between MI and MEF.

The decree will, in addition to the above-mentioned indicators of social, economic-cultural status and early school exchange, also identify reference thresholds for identifying schools in which regional school offices may authorize derogation.
