Main post-emergency measures of interest to schools: Conformity scheme and cycle

The DL of March 24, 2022, n. 24 “Urgent provisions to overcome measures to combat the spread of the COVID-19 epidemic, as a result of the disruption of the state of emergency”, in force since 25 March 2022, provides that by 31 March the deadline from the end of the state of emergency, and until 31 December 2022, a phase of gradual return to normalcy, because despite the disruption of the state of emergency, the need to combat the spread of the pandemic still persists. This assumption, in fact, updates and evaluates the methods for managing positivity cases.

Isolation and self-monitoring

Many school principals are currently taking explanatory notes to better reorganize education and school services in light of the very recent regulatory changes, but not only through the Legislative Decree of March 24, 2022, n. 24. One of these is the CI Giulio Higher Education Institute (a professional institute for commercial services, a professional institute for social and health services and a technical institute for tourism) of Turin.

Isolation (positive cases)

From April 1, 2022, it is forbidden to move from their home or residence to persons subject to the measure of isolation by disposition of the health authority, as they test positive for SARS-CoV-2 until recovery is determined.

Management of positive cases and distance learning activities

The art. 9, c. 1, replaced by Legislative Decree 24/2022 Art. 3, c. 4, of Legislative Decree 52/2021:

  • All students in isolation following SARS-CoV-2 infection can pursue school activities in integrated digital learning mode at the request of the family or student, if adult, accompanied by a specific medical certification that certifies the child’s health conditions. their full compatibility with participation in integrated digital education.
  • The repetition in the class of the above students is subject to the only demonstration that they have done a rapid or molecular antigen test with negative results, even in private centers that are authorized.

Evaluation of learning

The art. 9, c. 3, replaced by Legislative Decree 24/2022 Art. 87, c. 3rd, by Legislative Decree 18/2020:

  • The evaluation of the learning, periodic and final object of the didactic activity, which will be carried out in person or on television in the school year 2021/2022, will have the same effects as the activities for the first cycle school institutes of the Law Decree of 13 April 2017 provided, n. 62, and for the scholastic institutions of the second cycle of Article 4 of the Regulation laid down in the Decree of the President of the Republic of 22 June 2009, n. 122, and by Legislative Decree of 13 April 2017, n. 62.

Security measures to access and stay in school

The art. 9, c. 1, replaced by Legislative Decree 24/2022 Art. 3, c. 5, of Legislative Decree 52/2021 and provides that, until the end of the school year 2021-2022, the following safety measures will continue to be applied in schools:

  • Obligation to use respiratory protective devices of a surgical nature, or of higher protective effect, for subjects with pathologies or obstructions incompatible with the use of the above devices and to perform sports activities (keep distance and perform individual activities and not as a team ); it is recommended to respect an interpersonal safety distance of at least one meter, unless the structural logistical conditions of the buildings do not allow it;
  • Prohibition on entering or staying in school if positive for SARS-CoV-2 infection or if you have respiratory symptoms and body temperature above 37.5 °.
  • and anticipation of the signing of the future update of the 2021/2022 School Safety Protocol.

Entrance to the school for foreigners

The art. 9-ter.1 DL 52/2021 (obligation to hold and demonstrate basic green certification) has been extended until 30 April 2022 (Art. 6, c. 3, DL 24/2022):

  • “C. 1 By 30 April 2022, in order to protect public health, everyone who attends the structures of the school, educational and training institutes referred to in Article 9th, paragraphs 1 and 1 to provide access to school structures, educational and training institutions holding a green COVID certification and must show.19 in Article 9, Section 2. The provisions of the first sentence shall not apply to children, pupils and students, as well as for those attending regional training systems, with the exception of those attending training courses of High Technical Institutes and High Technical Education and Training Institutes “.

The obligation to obtain Covid-19 green pass certificates (Green Pass Base) will therefore be extended until 30 April 2022 for everyone who comes to the school premises.

They can therefore pick up on appointment interviews in the presence of the parents who request it, and after they have shown the green ground pass.

Personal protective equipment

The art. 10-square of Legislative Decree 52/2021 was amended by Art. 5, c of. 1, of Legislation 24/2022.

  • Until 30 April 2022 throughout the national territory, for workers, personal protective equipment (PPE) referred to in Article 74, Section 1, of the Legislative Decree of 9 April 2008, n. 81, surgical masks or higher

Until April 30, 2022, it is mandatory to wear FFP2 masks:

  • for school transport, for transport in general and travel
  • for shows open to the public indoors or outdoors in theaters, concert halls, cinemas, entertainment venues and live music and other similar venues, as well as for sporting events and competitions.

Until 30 April 2022, in all indoor spaces, including school premises, except those referred to in paragraph 1 and with the exclusion of private homes, it is mandatory to carry respiratory equipment throughout the national territory.

Educational excursions in the area and educational trips

Provides opportunities for educational trips and educational trips, including participation in sporting events, with a view to art. 14 which removes the articles. 1 and 2 of Legislative Decree 52/2021 (respectively restoration of the discipline of the yellow zones, etc. and measures concerning travel) without prejudice to the fact that the circular of the School Director Professor Fiorella Gaddò, of the CI Giulio University of Turin ( which is attached as an excellent example of legal practice), for educational trips:

Travel and educational travel information: Restrictions

For educational trips and educational excursions, these are the restrictions specified in the regulatory provision, from 1 to 30 April 2022, for travel, the basic GP is required for transport, while the enhanced GP is required for access:

  • Swimming pools, swimming pools, gymnasiums, team and contact sports, wellness centers, including indoor facilities, for indoor activities, as well as rooms for clothes and showers, with the exception of the certification requirement for nursing staff who are not self-employed due to age or disability;
  • Conventions and congresses;
  • cultural centers, social and leisure centers, for activities that take place inside and with the exception of educational centers for children, including summer centers, and related catering activities.

Until April 30, 2022, it is mandatory to wear respiratory protection devices in all indoor places as mentioned above and with the exception of private homes throughout the national territory.

In contrast to the spread of the pandemic

It is considered appropriate to emphasize that, while the need to combat the spread of the pandemic still exists, all previous provisions issued by internal notes concerning:

  • Use of the toilets
  • Use of vending machines:
  • Using the internal bar.
